1. Objective & Scope of Policy

Realtics Inc. ("Realtics," "we," "us," or "our") is committed to maintaining high standards of confidentiality with respect to the Personal Information provided to us. This Privacy Policy ("Policy") governs the collection, use, and disclosure of Personal Information from and about individuals who use our platform, website, and services (collectively, the "Service").

This Policy aligns with the Personal Information Protection and Electronic Documents Act (PIPEDA) and the privacy standards mandated by the Toronto Regional Real Estate Board (TRREB).

Application: This Policy applies to all Users of the Service, including real estate salespersons, brokers, and their clients. It does not apply to aggregated, anonymized data from which the identity of an individual cannot be determined.

2. Definitions

  • "Personal Information" means any information, recorded in any form, about an identifiable individual, or an individual whose identity may be inferred or determined from the information, alone or in combination with other information.
  • "User" means a real estate professional or other individual registered to use the Service.
  • "Client Data" means Personal Information about a User's client (e.g., name, property address) entered into the Service by the User.

3. Collection of Personal Information

We collect Personal Information necessary to fulfill our mandate of providing advanced real estate analytics and documentation services. This includes:

3.1 Information You Provide

  • Identity Data: Name, professional title, brokerage affiliation, RECO registration details.
  • Contact Data: Email address, phone number, business address.
  • Client Data: Names and property addresses of your clients, entered for the purpose of generating forms or presentations.
  • Financial Data: Payment card details and billing address (processed securely by our payment provider, Stripe).

3.2 Automated Collection

  • Technical Data: IP address, browser type, device information, operating system.
  • Usage Data: Pages visited, features used, time spent on the platform, and interactions with AI tools.
  • Cookies: We use cookies to maintain your session, remember preferences, and analyze traffic.

4. Use of Personal Information

We use Personal Information solely for the following purposes:

  • Service Delivery: To authenticate Users, generate AI content, populate real estate forms, and provide listing analysis.
  • Communication: To send administrative notices, security alerts, and support responses.
  • Service Improvement: To analyze usage patterns and improve our AI models and user interface.
  • Legal Compliance: To comply with PIPEDA, TRREB rules, and other legal obligations.
  • Security: To detect, prevent, and address fraud, security breaches, or technical issues.

AI Training Note: We may use de-identified, aggregated Usage Data to train and improve our machine learning models. We do not use Client Data (Personal Information of your clients) to train public models without your explicit consent.

5. Disclosure of Personal Information

We do not sell, trade, or rent Personal Information to third parties. We disclose Personal Information only in the following circumstances:

  • Service Providers: We transfer data to trusted third-party service providers who process it on our behalf (e.g., OpenAI for AI processing, Supabase for database hosting, Stripe for payments). These providers are contractually bound to protect your data and use it only for the purposes we specify.
  • Legal Requirements: We may disclose information if required to do so by law, court order, or government regulation (e.g., RECO investigation, court subpoena).
  • Business Transfers: In the event of a merger, acquisition, or sale of assets, Personal Information may be transferred as a business asset, subject to this Policy.

6. TRREB & MLS® Data Privacy

As a provider of services utilizing MLS® Data, we adhere to strict privacy obligations regarding listing information:

Accuracy

Realtics endeavours to ensure that any Personal Information provided by its Users and in its possession is as sufficiently accurate, current, and complete as necessary for the purposes for which we use that information. Information regarding MLS® listings is the responsibility of the Members who provide it to the MLS® system.

Retention

Realtics retains Personal Information only as long as necessary to fulfill the purpose for which it was collected. Listing data is retained in accordance with TRREB's data retention policies.

Security

Realtics maintains adequate physical, procedural, and technical security with respect to its information storage facilities to prevent loss, misuse, or unauthorized access.

7. Data Security & Storage

We implement industry-standard security measures, including encryption in transit (TLS 1.2+) and at rest (AES-256), access controls, and regular security audits.

Data Residency: Your Personal Information may be stored and processed in Canada and the United States. By using the Service, you consent to the transfer of information to countries outside of your country of residence, which may have different data protection rules.

8. Your Rights (PIPEDA)

Under PIPEDA, you have the following rights regarding your Personal Information:

  • Access: You have the right to request access to the Personal Information we hold about you.
  • Correction: You have the right to request correction of inaccurate or incomplete information.
  • Withdrawal of Consent: You may withdraw your consent to our collection and use of your Personal Information at any time, subject to legal or contractual restrictions and reasonable notice.
  • Challenging Compliance: You have the right to challenge our compliance with these principles.

9. Consent Agreement

When you provide Realtics with Personal Information, you explicitly consent and agree to:

  • The collection, use, and disclosure of Personal Information as described in this Policy.
  • The acceptance of the risks concerning the transmission of information over the Internet.
  • The amendment of this Policy from time to time.
